I read the post oldirtybootz made on the State Farm ad earlier. I wanted to comment, but comments weren't allowed.

It sucks being in an accident, especially if it's not your fault. Just because they hit you doesn't mean you have to go through their insurance.

I got into a crash where the other person was 100% at fault. They had cut rate cheap-o insurance and wanted me to go to a ghetto body shop to get it fixed. I declined this, went to a body shop I knew and was covered by my insurance, and my insurance company recovered the claim through their battle with the other company. They went through the hassle of dealing with the crappy insurance company instead of me, and I got my car fixed where I wanted to!

Think about this before you drop off your car at the other person's insurance-approved body shop.

I'll share a little story with you because it cracks me up to no end. My dad got hit 2 years ago. My mom, dad, and I were sitting at a light and got rear ended by some idiot not paying attention. No one was hurt, but it did smash up the bumper of our car. It happened right in front of the town police station so an officer came out, took statements, wrote a report, and charged the guy. My dad calls the insurance company (hint.. you've already mentioned this company) and it goes something like this:

Agent: "Oh, so it turns out that guy's policy had lapsed, he had no insurance. Do you want to pursue legal action for compensation for your damages?"

Dad: "Of course."

Agent: "OK, great. We will close out everything here and send you a list of attorneys we recommend so that you can setup an appointment to begin pursuing the matter."

Dadplosion imminent in 3...2...1... "WHY DO I HAVE TO CALL AN ATTORNEY? I THOUGHT THAT'S WHAT THE F*CK I PAY YOU A*SHOLES TO DO!..." My dad can make a sailor blush, trust me, I was a sailor.

Long story short, Dad got the car fixed at a local body shop we know and trust, and the insurance company "handled it."

The other day I get a phone call from him, and he's heated. Apparently they threw the first punch in Round 2. He got a notice they are raising his rates due to "excessive claims." Which is 2 in the past 5+ years, one for a windshield repair (the deductible covers most of this anyways) and this accident for which he wasn't at fault.

I almost feel sorry for my dad's agent. Almost.

Yep, I do this every time. One thing you've got to keep an eye on is that your insurance closes your claim once they recoup so you don't get a rate bump. I've never had an issue, but last time this came up some folks had.

Also, in most, if not all, states an insurance company legally cannot force you to use any particular shop. You were probably just getting dicked around so another good reason to go through the company you trust.

My insurance company went through a lengthy battle to recover damages from cheap-o insurance, but they still closed the claim and got me a check. All was well in my case.
